The word “model report” refers to the technical information compiled by VOSA in a document that can be used to support a vehicle meeting technical standards set out by the ESVA test.

These Terms and Conditions of Use are intended for all individuals ["Users"] who access and/or enter into any part of the Company's web site ["Site"].

The Company reserves the right to amend and/or add, delete all provisions mentioned below and other information within these Terms and Conditions of Use, from time to time without notice.

Limitation of Liability and Disclaimer - IMPORTANT

The service offered by the company is designed as a renting system that enables an individual to rent the model report (compiled by VOSA and owned by the company) to apply for a VOSA approved ESVA test. However, the use of the service does not imply any form of guarantee in a VOSA approved ESVA test pass. The application of the Model report is outside our control and in particular the preparation and status of your vehicle. There is no guarantee in any form or implication, that renting a report will result in a VOSA approved ESVA test pass.

Certain model reports will state that additional parts (both physical and electronic modification) may need to be fitted to your vehicle before attempting to pass a VOSA approved ESVA test, such parts may be purchased from Model Reports Direct Ltd. or their approved suppliers.

Certain model reports have a usability clause where they can only be used at a specified VOSA approved ESVA centre. It is your responsibility to check this usability clause before renting any report.

Service

Model Reports Direct Ltd offer model reports as a rental commodity and your rights to this service are subject to your invoice being paid in advance.

Each model report rental is licensed to the user for use only once against a specific designated vehicle chassis number provided by the user to the company. Users may not resell or assign a model report we have rented to the user.

All prices stated on the Model Reports Direct Ltd. website are subject to VAT at 17.5%.

If your ESVA application is suspended or terminated for any reason then you will not be entitled to any refund for our model report service relating to the application.

Methods of Payment

Making a single rental purchase of a model report on the website can be paid for via most major credit cards, if you prefer not to send this information online you can phone Model Reports Direct Ltd. on +44 (0) 117 316 7888.

All credit card numbers are encrypted when the rental order is placed using 128bit encryption. They are only decrypted after they reach our computers. They are not held in clear text on any website.

Payment for rental of model reports based on our volume usage credit scheme can not be made by credit or debit card. In order for credits to be assigned to your account the company must receive full payment by cleared funds in advance.

Credit Scheme

The credit scheme is a service targeted at the volume user allowing discount from normal prices on the basis that rental options are pre-paid in bulk.

The word “credits” is referred to as being the units used for pre-paid rental of model reports. Credits are only valid subject to your invoice being paid in advance. Once purchased credits have no cash value and no entitlement to refund or transfer.

The company can assign credits to your dealer account on our website subject to your invoice being paid in advance. We regret that we can not accept credit card payment for the purchase of credits.

Once credits have been assigned to your account, you can redeem them for rental of model reports using our website. In redeeming these credits you are bound to the terms and conditions of the company.

Rental cost of a model report is shown in credits. The value shown (in credits) will be deducted from the pre-paid balance (of credits) upon the company giving permission for rental of any model report requested by you using the website.

Privacy Policy

Model Reports Direct Limited believes strongly in protecting user privacy and do not disclose buyers' information to third parties.

Data on this site is used to:

* Take and fulfil customer orders.
* Administer and enhance the site and service

Returns Policy

Refunds are not available once you have paid the amount due on your invoice, and/or, your rental authorisation has been released to VOSA.

Intellectual Property

All content and materials available on this site, and/or, in Model Reports Direct Ltd, are our intellectual property. Except as expressly authorised by us in writing to you, you agree not to sell, license, rent, modify, distribute, copy, reproduce - directly or indirectly, transmit, publicly display, publish, adapt, edit, or create, derivative works from such materials or content at any time. You may receive and display the content from the website on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your personal, non-commercial use.

General

You may not assign, sub-license or otherwise transfer any of your rights under these terms.

Failure by the company to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy. We reserve the right, in our sole discretion, to terminate your access to all or part of this site and service, with or without notice.

Headings in these terms are for convenience only and will have no legal meaning or effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and us in respect to this site and the site services, and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and us. If any of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms, which shall remain in force and effect.

These terms shall be governed by and construed in accordance with English law.

The parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute, which may arise out of, under or in connection with these terms, or the legal relationship established by them and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.
